Terms of Service

Preamble

These Terms of Service (hereinafter "Terms") are entered into between Peltek, an individual business (EI) with its registered office at 200 rue de la Croix Nivert, 75015 Paris, France, registered in the Paris Trade and Companies Register under SIRET number 942 968 330 00012, hereinafter referred to as "Releasy", operating the platform available at usereleasy.com, and any natural or legal person subscribing to or using the Service, hereinafter referred to as "the Customer".

The Customer declares having full legal capacity to be bound by these Terms. In the case of a subscription on behalf of a legal entity, the natural person completing the registration declares being duly authorised to bind such legal entity.

Important notice

Releasy is a software service provided exclusively in digital form (SaaS). No physical product is sold or shipped under these Terms.

Article 1 – Purpose

These Terms define the rights and obligations of the parties in connection with the subscription to and use of the services offered by Releasy through its online platform.

Access to the Service, regardless of the plan subscribed (including the free plan), implies unconditional acceptance of these Terms. The applicable Terms are those in force on the date of subscription or renewal.

Releasy reserves the right to modify these Terms at any time. Substantial modifications will be notified by email at least 30 days before taking effect for active subscriptions.

Article 2 – Service Description

Releasy is an AI-powered SaaS platform that automatically generates professional release notes and changelogs from commits, pull requests and issues in Git repositories (GitHub, GitLab).

The main features of the Service include:

  • Read-only connection to GitHub and GitLab repositories via OAuth
  • AI-assisted generation of release notes by version or time period
  • Production of audience-tailored versions (technical, marketing, executive, support, etc.)
  • Export in multiple formats (Markdown, HTML, Slack, Discord, Confluence, JSON/API, GitHub Releases, etc.)
  • Saveable preset system to automate recurring generations
  • API access and webhooks for CI/CD pipeline integration (paid plans)
  • Automatic breaking change detection, SemVer versioning and content security

The Service's billing unit is the Compute Unit (CU). Each generation consumes a number of CUs calculated based on the volume of code analysed and the number of repositories involved. All generations remain in draft status until explicitly approved by the Customer.

Releasy reserves the right to evolve the Service's features, add new ones or modify existing ones, provided this does not substantially degrade the level of service subscribed.

Article 3 – Account Access and Creation

Access to the Service requires creating an account by providing a valid email address and password, or via OAuth authentication (GitHub, GitLab). The Customer is solely responsible for the confidentiality of their login credentials.

Connection to source code repositories is carried out exclusively via the OAuth authorisation mechanisms provided by GitHub and GitLab. Releasy stores no SSH keys or authentication data beyond the OAuth tokens required for the Service to function.

Read-only access

Releasy only requests read-only permissions on connected repositories. The Service never modifies any source code.

The Customer agrees to use the Service only for repositories they own or for which they have the necessary authorisations. Any unauthorised access to third-party repositories is strictly prohibited.

Article 4 – Subscriptions and Pricing

4.1 – Subscription plans

Releasy offers the following subscription plans, in euros (VAT included for EU consumers):

  • Free – €0/month: 30 CU/month, basic generation features, no API or webhooks
  • Starter – €19/month: 150 CU/month, all features including API, webhooks and saved presets
  • Pro – €49/month: 500 CU/month, same features as Starter
  • Scale – €99/month: 1,200 CU/month, same features as Starter
  • Enterprise – from €199/month: 3,000+ CU/month, SAML/OpenID SSO, advanced role management, SLA, custom quota

Prices are shown inclusive of VAT for consumers and exclusive of VAT for VAT-registered businesses.

4.2 – Additional CU packs

The Customer may purchase additional CUs as one-time packs, not carried over to the next period:

  • 100 CU pack – €12
  • 300 CU pack – €29
  • 1,000 CU pack – €79

4.3 – Price revision

Releasy reserves the right to modify its pricing at any time. For active subscriptions, any price revision will be notified by email at least 30 days before its application at the next renewal date. The Customer may cancel without penalty before the new pricing takes effect.

4.4 – Promotional offers

Releasy may offer time-limited promotional offers. Their specific terms will be specified at the time of publication. Unless otherwise stated, promotional offers cannot be combined.

Article 5 – Orders, Payment and Billing

5.1 – Subscription process

Subscribing to a paid plan is done entirely online via the Customer dashboard:

  • Select plan on the pricing page
  • Enter billing information
  • Validate payment method
  • Confirm subscription

The subscription takes effect immediately upon payment confirmation. In the event of an upgrade mid-period, the amount is prorated for the remaining days of the current cycle.

5.2 – Payment methods

  • Credit/debit card (Visa, Mastercard, American Express)
  • SEPA direct debit (recurring subscriptions)

Payment security

Payments are processed by Stripe, a PCI-DSS Level 1 certified provider. Releasy never stores any banking data.

5.3 – Renewal and billing

  • Subscriptions renew automatically at the end of each period (monthly or annual)
  • Invoices are issued electronically and sent by email at each renewal
  • The CU quota is reset at each renewal; unused CUs are not carried over

5.4 – Late or failed payment

In the event of a failed payment, Releasy will make several debit attempts before notifying the Customer by email. Without resolution within 15 days, Releasy reserves the right to suspend access to the Service. Statutory late payment interest and a minimum fixed recovery fee of €40 may be applied.

Article 6 – Right of Withdrawal

Legal withdrawal period

In accordance with Article L.221-18 of the French Consumer Code, consumer Customers have 14 days from the date of subscription to exercise their right of withdrawal, without needing to provide any reason.

To exercise this right, the Customer must notify their decision by email to [email protected], clearly stating their withdrawal request, contact details and subscription date.

Exception to the right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for services fully performed before the end of the withdrawal period, where performance began with the Customer's express prior consent and acknowledgement that they would lose their right of withdrawal.

The right of withdrawal does not apply to business Customers acting in the course of their commercial activity.

Article 7 – Termination

7.1 – Termination by the Customer

The Customer may cancel their subscription at any time from their dashboard. Cancellation takes effect at the end of the current billing period; no prorated refund is made for the remaining period, unless Releasy has made a substantial modification to the Service.

Exceptionally, in the event of a substantial change to features or a price increase, the Customer may cancel without penalty before the modifications take effect.

7.2 – Termination by Releasy

Releasy reserves the right to terminate the Customer's account with immediate effect in the event of:

  • Non-payment after two unsuccessful reminders
  • Serious or repeated breach of these Terms or the terms of use
  • Fraudulent or abusive use of the Service
  • Order from competent authorities

7.3 – Effects of termination

Upon the effective date of termination, the Customer's access to the Service is deactivated. The Customer has 30 days to export their data (generated release notes, presets). After this period, data may be permanently deleted.

Article 8 – Service Availability

Releasy commits to ensuring platform availability of 99.5% on a monthly basis, excluding planned maintenance and force majeure events. Planned maintenance will be notified at least 24 hours in advance by email or via the dashboard.

Releasy shall not be liable for service interruptions resulting from failures of third-party services (GitHub, GitLab, AI providers, cloud infrastructure), or from events beyond its control.

Service status

The real-time platform status is accessible from the Customer dashboard. Incident notifications can be enabled in account settings.

Article 9 – Customer Obligations and Responsibilities

9.1 – Compliant use

The Customer agrees to use the Service in compliance with applicable laws and these Terms, and in particular to:

  • Only connect repositories they own or for which they have the necessary rights
  • Not attempt to circumvent the Service's quota or security mechanisms
  • Not use the Service for unlawful, fraudulent or harmful purposes
  • Keep billing information up to date to ensure service continuity

9.2 – API and webhook usage

Access to the Releasy API (paid plans) is subject to rate limits defined by the subscribed plan. Any use exceeding these limits in order to circumvent the CU quota is strictly prohibited and may result in account suspension.

9.3 – Responsibility for generated content

Releasy generates content from data provided by the Customer. The Customer is solely responsible for reviewing, validating and publishing this content. Releasy shall not be held liable for the accuracy, completeness or suitability of generated release notes to the Customer's specific requirements.

Article 10 – Intellectual Property

10.1 – Releasy's property

All elements of the Releasy platform — software, algorithms, interfaces, trademarks, logos, documentation — are and remain the exclusive property of Releasy or its licensors. These Terms do not transfer any intellectual property rights to the Customer.

Rights protection

Any unauthorised reproduction, decompilation, modification or exploitation of the platform, its components or its documentation is strictly prohibited.

10.2 – Ownership of generated content

Release notes and changelogs generated by the Service from the Customer's data belong to the Customer. Releasy claims no rights over content produced on behalf of the Customer.

Releasy reserves the right to use anonymised and aggregated data from generations to improve the Service, without any personally identifiable data or source code being reused.

Article 11 – Personal Data Protection

The processing of personal data is governed by Releasy's Privacy Policy, accessible at usereleasy.com/legal/privacy, and compliant with the GDPR (EU 2016/679).

11.1 – Data collected

  • Account data: email, name, organisation
  • Billing data: information required for payment processing via Stripe
  • Repository metadata: commit messages, PR/issue titles (read-only, never source code)
  • Usage data: CU consumption, generations performed

11.2 – Data retention

  • Account data: retained for the duration of the active subscription, then 3 years after cancellation unless deletion is requested
  • Generated content: accessible until account deletion or explicit Customer request
  • Billing data: retained 10 years in accordance with legal accounting obligations

11.3 – Customer rights

In accordance with the GDPR, the Customer has rights of access, rectification, erasure, portability and objection regarding their data, exercisable at [email protected].

Article 12 – Third-Party Services

Releasy relies on third-party services and infrastructure. The Customer accepts that use of the Service involves the following providers:

  • GitHub / GitLab – repository access via OAuth, subject to their respective terms of use
  • AI providers – content processing for release note generation
  • Stripe – payment processing, PCI-DSS certified
  • Cloud infrastructure – platform hosting and execution

Third-party liability

Releasy cannot be held responsible for interruptions, modifications or failures of third-party services beyond its control. The terms of use of these services are binding on the Customer when using the Service.

Article 13 – Limitation of Liability

To the extent permitted by applicable law, Releasy shall not be liable for:

  • Data losses or service interruptions due to events beyond its control
  • AI-generated content and its suitability for the Customer's specific needs
  • Failures of third-party services (GitHub, GitLab, AI providers)
  • Indirect damages, loss of revenue or data, loss of profits
  • Any use of the Service not in compliance with these Terms

Liability cap

Releasy's total liability under these Terms is limited to the total amount actually paid by the Customer during the 6 months preceding the event giving rise to the claim.

Article 14 – Force Majeure

Releasy's obligations are suspended in the event of a force majeure event or fortuitous event preventing their performance. Releasy will inform the Customer of the occurrence of such an event as soon as possible.

  • Natural disasters, fires, floods
  • Major failures of telecommunications or internet networks
  • Large-scale cyber attacks (DDoS, ransomware, etc.)
  • Strikes or social unrest affecting essential service providers
  • Pandemics or health crises
  • Government or regulatory decisions making the Service impossible to provide

Article 15 – Final Provisions

15.1 – Governing law and jurisdiction

These Terms are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of French courts, subject to mandatory provisions applicable to consumer Customers in the European Union.

15.2 – Mediation

In the event of an unresolved dispute, consumer Customers may use a free consumer mediator in accordance with Articles L.611-1 et seq. of the French Consumer Code.

15.3 – Severability

If any provision of these Terms is declared void or unenforceable, the remaining provisions will remain in full force and effect.

15.4 – Entire agreement

These Terms, together with the Privacy Policy and any specific contractual addenda, constitute the entire agreement between the Customer and Releasy for use of the Service.

Effective date

These Terms take effect on 11 April 2025 and supersede all previous versions.
